Rules, Terms and Conditions

This agreement(the "Agreement") should be read by you in its entirety. This Agreement constitutes a legally binding agreement between you(the "User") and Netbuks S.A. (the "Corporation") which owns and operates the PokerBiz.com website and software (the "Software").

1. All Users must be over 18 years of age. Further age restrictions may apply depending on your local laws and regulations.

2.You may not: (a) permit other individual(s) to use the Software unless such other individual(s) agree in writing to accept these Rules, Terms and Conditions; (b) modify, translate, reverse engineer, de-compile, disassemble or create derivative works based upon the Software; (c) copy the Software; (d) rent, lease, transfer, sublicense or otherwise transfer rights to the Software; (e) remove any proprietary notices or labels on the Software, including the code underlying the Software; or (f) use the Software for any reason other than your private use.

3. The Corporation is not responsible for claims for losses or damages resulting from real money (or play money) play under any condition. Play at PokerBiz.com is at the sole option, discretion and risk of the User. The User is also responsible for maintaining the secrecy and security of their account passwords and other personal security information. The Corporation is not responsible for the unauthorized use of your account or any losses that may result, of such unauthorized use.

4. The Corporation also has the right to hold any and all of a player's funds indefinitely if it is found, determined at the sole discretion of the Corporation, that the player has been involved in fraudulent activity on PokerBiz.com. Fraudulent activity may include, but is not limited to, stolen credit cards, transfer of funds to other player accounts (chip dumping), forgery, collusion and the provision of false account information.

5.You may only use the Software in accordance with the rules posted on the PokerBiz.com site, as may be modified from time to time. In cases where disputes arise between players, you agree that judgments of the Corporation are final, binding and conclusive in all matters. All taxes, duties and fees applicable in connection with any money or prizes awarded to a User are the User's sole responsibility. Violation of any part of the Agreement may result in suspension or termination of the User's PokerBiz.com account.

6.The Corporation does not warrant that the User's use of the Software will be uninterrupted or that the operation of the Software will be error-free or secure or bug free.

7.The Corporation is not responsible for any losses incurred by you in real money play. The Software is provided "AS IS." THERE ARE NO WARRANTIES OF ANY KIND AS TO THE SOFTWARE'S IMPLIED MERCHANTABILITY OR TO FITNESS FOR A PARTICULAR PURPOSE, EVEN IF the Company HAS BEEN ADVISED OF THAT PURPOSE. The Company WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE EVEN IF the Corporation HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This Agreement will not be governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is expressly excluded.

8.You agree to hold harmless, indemnify and defend the Corporation, its officers, directors, employees and contractors, from and against any losses, damages, fines and expenses (including attorneys' fees and costs) resulting from your violation of any of these Rules, Terms and Conditions.

9.If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability will not invalidate or render unenforceable any other part of this Agreement, but the Agreement will be construed as not containing the particular provision or provisions held to be invalid or unenforceable.

10. PokerBiz.com will collect information from browsers through using 'cookies'. The information will be, for example, the type of browser you use, your I.P. number etc. This information is collected for security reasons and authentication reasons. PokerBiz.com aims for minimal use of cookies.

11.Each User is only allowed to have one account with PokerBiz.com

12. It is up to each User to make sure that no local laws or regulations are violated.You may use the Software if you are over the age of 18( or other such minimum legal age in your jurisdiction),or if it is legal according to the laws that apply in your jurisdiction. You may not use this Software fom Costa Rica. Any breach will result in such an account being suspended and closed.

13.All Users are obliged to provide their full and accurate personal details. Failure to provide full and accurate personal details may result in disqualification, account closure or forfeiture of funds.

14. If a dispute arises between Users or between a User and the Corporation the judgement of the PokerBiz management is final, binding and conclusive in all matters.

15.Users shall not hold the Corporation, its owners, employees, affiliates or other companies or people linked to the Corporation responsible for any costs or damages caused by: a. the use of the website, b. the use of any material from the website, c. the use of any of our servers, d. the use of any of our software, e. participation in any game or f. the winning of any prize.

16.Any changes in the User's personal information should be updated in the User account as soon as possible.

17.The Corporation or associated companies does not report client's winnings to any government agencies. It is solely the User's responsibility to report any income from gaming activities to his/her government agencies, if required.

18.The Corporation reserves the right to cancel your player account for any justifiable reason whatsoever at any time without notice to you. If you do not access your account by "logging in" to your account for a period of eighteen (18) months, your Account will be deactivated and the entire account balance will be deemed abandoned and forfeited. Such requirement for log-in and entry is not and does not constitute any requirement whatsoever for you to play any game, deposit funds or participate in any activity at PokerBiz.com other than logging in.

19.The Corporation reserves the right to make changes and additions to these Rules, Terms and Conditions from time to time.It is the responsibility of the User to become aware of any such changes. Continuing to use the facilities of PokerBiz.com indicates a User's acceptance of all such rules.



Privacy Policy

1. By providing your Personal Information and registering with us or logging on with us when you enter our website, you explicitly consent to PokerBiz.com processing and disclosing your Personal Information for the purposes, and otherwise in the manner, set out on this page, or as otherwise provided in accordance with the Rules,Terms and Conditions.

2. Personal information is any information about you that identifies you or by which your identity can be reasonably determined.

3. PokerBiz.com only collects personal information that is necessary for one or more of our functions or activities. The types of personal information which are collected from our clients includes name, address, birth date, payment card details, details of gaming transactions and account transfers and any other information clients wish to provide.

4. Personal Information may be submitted to our website. You will be asked to provide your Personal Information in this area for the purpose of registering and opening an account with us.

5. A "cookie" is used to identify the Account Holder\uFFFDs preferred language so it is automatically selected when the account holder returns to PokerBiz.com. Our web server will record the pages you visit within our website.

6. Where possible, we will give you the opportunity to decline to provide any personal information we request, but in some cases your use of this website may be restricted if you do not provide the requested information.

7.PokerBiz.com will process your Personal Information to administer your account, maintain our accounts and records, monitor website usage levels and the quality of the service we provide and to inform you, from time to time, about products and services that we consider may interest you. PokerBiz.com will also retain such information and may analyse it if asked to do so in order to investigate any actual or suspected criminal activity or, in respect of any event featured on our website, any threat to the integrity of that event and/or breaches of the rules of that event as laid down by the relevant governing bodies.

8. PokerBiz.com reserves the right to share personal information to marketing partners that is also bound by this privacy policy.

9. PokerBiz.com may also disclose your personal information in certain circumstances. Sometimes we are required or authorised by the law to disclose your personal information. For example PokerBiz.com discloses personal data when ordered to do so by order of the Governing Authorities and/or under provision in the Governing Law. Furthermore, PokerBiz.com reserves the right to disclose personal data to relevant recipients when pokerbiz.com has reasonable grounds to suspect irregularities that involve a PokerBiz.com account.

10. We may also disclose your personal information where you have consented to us doing so. Your consent to the disclosure of your personal information may be given explicitly such as in writing or verbally or may be implied from your conduct such as when you discuss details of the relationship you have with us publicly with the media.

11. Additionally, your Personal Information may be disclosed to any regulatory or sporting body in connection with policing the integrity or enforcing the rules of a sport or game and/or prevention and detection of crime and with whom PokerBiz.com has agreements from time to time for the sharing of such data and where the Club considers that there are reasonable grounds to suspect that you may be involved in a breach of such rules or the law, have knowledge of a breach of such rules or the law or otherwise pose a threat to the integrity of the relevant sport or game. Those bodies may then use your Personal Information to investigate and act on any such breaches in accordance with their procedures.
